New mandatory section 8/13 forms
The bulk of the changes introduced under the Deregulation Act 2015, and all the negative ones for landlord, are expected to become effective later this year, on the 1st October.
These include measures to prevent so-called retaliatory evictions, limitations on section 21 notices, and a new right to rent refund for tenants.
However, there is a silver lining, albeit temporary. For a period of 3 years, these new provisions will only apply to new tenancies except statutory periodic ASTs.
Therefore you could buy yourself a 3 year reprieve:
- If you are considering renewing a fixed term AST, or granting any replacement AST, try to do it no later than September.
- If a fixed term AST comes to an end after September, take a moment to weigh the pros and cons of renewing. You could just keep your tenant on a statutory periodic AST and avoid the new provisions until 2018.
